the ai pace debate just moved into court. paid subscribers sued openai, anthropic, xai and google on september 18, arguing a coordinated slowdown of model releases cut the value of their subscriptions.

the court gets to define what shipping fast means.

Context

The complaint in Buist et al. v. Anthropic PBC et al., Case 3:26-cv-10693, was filed on 18 September 2026 in the US District Court for the Northern District of California, San Francisco Division, by paid subscribers including Charles Buist and Cheyenne Hunt against Anthropic PBC, OpenAI OpCo LLC, SpaceXAI and Google. Bloomberg Law, 18 September 2026, says it alleges a Section 1 Sherman Act violation and that plaintiffs seek class certification, an injunction and declaratory judgment. The complaint alleges an agreement among the four to slow the pace at which they improve competing consumer products, which it says was triggered by a 12 September essay by Anthropic's CEO titled We Must Pace the Frontier, and says plaintiffs do not challenge any defendant's unilateral safety or pacing decisions.

How it compares

The filing date, court and parties come from the complaint header. These are allegations and not findings. No ruling, class certification or defendant response was inspected, and the docket was not checked. The complaint describes an agreement on pace of improvement and not a freeze on releases. The note's xAI is shorthand, since the complaint and Bloomberg Law name SpaceXAI. The court gets to define what shipping fast means is the author's take.
